Often disputes arise at the end of a tenancy over seemingly simple matters such as the state of cleanliness of the property, or the definition of 'fair wear and tear'. It is impossible to assess these issues without a definitive 'before' and 'after' picture. We can help to minimise these disputes by producing detailed and accurate independent inventories of the property, performing inspections, and completing reports at the tenancy check-in and check-out.
New regulations that came into force in 2007 have had a big impact on the lettings and rental market for estate agents, landlords and tenants. The Tenancy Deposit Scheme (TDS) regulates the way in which deposits are held and the way in which disputes are dealt with at the end of the tenancy.
With the implementation of the TDS, tenants will have the right to know where their deposit is being held and the right to refer deposit disputes to an independent dispute resolution service such as the Tenancy Dispute Service (www.thedisputeservice.co.uk).
An independent and professionally prepared inventory, check-in and check-out report will be the core documentary evidence used in dispute resolution and under the new regulations, property owners may find it difficult to claim against a deposit refund if an independent inventory has not been prepared at the tenancy outset.
